Cape York Hunting Lodge – Property Terms & Liability Waiver

1. Agreement to Terms
   By entering, staying at, or participating in activities at Cape York Hunting Lodge, Koolburra Station, guests acknowledge they have read, understood, and agreed to these Terms & Conditions and Liability Waiver.
   
   

2. Guest Responsibilities

·       Guests must respect the Station Rules, station staff personal areas and property, and other guests quite enjoyment.

·       Follow staff directions.

·       Report any property damage immediately to the appropriate staff member.

·       Guests must clean up after themselves and dispose of waste responsibly in the designated bins.

·       Pets must be kept in designated areas and on a leash.

·       No unauthorised visitors on site without approval.

3. Property Rules

·       No unaccompanied or unescorted access applies to the entire property, with no exceptions.

·       No hunting or shooting unless guided by authorised staff or Hunt NQ Guides.

·       Do not interact with livestock (cattle and horses)

·       Give way to stock, horses, motorbikes, and vehicles being ridden or driven by station staff.

·       Report all sick or injured livestock to the appropriate staff member

·       Do not disturb wildlife

·       No private motorbikes or quad bikes are permitted to be used on the property

·       No access to station staff quarters, cattle yards, sheds, machinery, or equipment.

·       No access to restricted areas.

4. Property Risk Acknowledgement
   Guests acknowledge there are inherent risks of staying on a working property including potential interaction with property management practices, extensively run livestock, plant livestock, terrain, and weather.
   
   

5. Guests assume all risks.

The Operator of Cape York Hunting Lodge and its staff are not liable for injury, loss, or death unless due to proven negligence.
Guests agree to indemnify the Operator of Cape York Hunting Lodge against all claims.

Guests voluntarily accept all risks associated with entering and remaining on the property.

6. Hunting & Guided Activities
   • All hunting and guided tour activities conducted on or from Cape York Hunting Lodge, Koolburra Station are independently operated by Hunt NQ.
   • Hunt NQ is solely responsible for all hunting activities, including safety, supervision, licensing, compliance, and conduct.
   • Guests participating in these activities must comply with all rules, instructions, and waivers issued by Hunt NQ.
   • No unsupervised hunting is permitted on the property. All hunting activities must be conducted under the supervision of authorised Hun NQ guides unless otherwise approved in writing by Hunt NQ.
   
   

7. Access to water
   Entering water is at the guest’s own risk.
   The Operator of Cape York Hunting Lodge and Hunt NQ accept no liability.
   All rivers, water courses and water bodies (e.g. stock dams) may contain crocodiles, dangerous wildlife and other hidden obstacles.
   All rivers and water courses may be subject to rapid changes in water levels and currents following heavy rain (which may not have been local).

No warranty as to safe swimming areas can be guaranteed.

Children must be supervised at all times near water.

8. Assumption of Risk & Release of Liability
   To the fullest extent permitted by law, guests release and discharge Cape York Hunting Lodge, its owners, employees, contractors, and agents from liability arising from:
   • Use of the property or facilities;
   • Natural hazards or wildlife encounters;
   • Actions of other guests or third parties;
   • Activities operated by Hunt NQ or other independent providers.
   
   

9. Indemnity
   Guests agree to indemnify and hold harmless Cape York Hunting Lodge, its owners, employees, and agents against claims, damages, liabilities, costs, or expenses arising from their actions, negligence, or breach of these terms.
   
   

10. Third-Party Liability
    Guests acknowledge that Hunt NQ operates independently from Cape York Hunting Lodge, Koolburra Station.

The Operator of Cape York Hunting Lodge, Koolburra Station does not own, manage, supervise, or control Hunt NQ activities and accepts no responsibility or liability for injury, loss, damage, or claims arising from services provided by Hunt NQ or other third-party operators.

11. Photo & Media Consent
• Guests acknowledge and consent that the Operator of Fairview Station Cape York may take photographs and/or video recordings during tours and activities, and that by signing this waiver they provide permission for such images and footage to be used by the Operator of Fairview Station Cape York for marketing, promotional, and operational purposes. 

• Guest Photos By voluntarily uploading or sharing images or videos to Fairview Station Cape York’s platforms (including PhotoCircle), guests grant permission for use in marketing, social media, and promotional materials.
• Guests confirm they have permission from individuals appearing in content.
• If guests do not wish their content to be used, they must refrain from uploading or notify in writing.
• Consent is royalty-free and ongoing. No compensation will be provided.

Acknowledgement of Terms

By entering the property or confirming a booking through Hunt NQ, guests acknowledge that they:
• Have read and understood these Terms & Conditions and Liability Waiver;
• Accept the inherent risks associated with remote properties and outdoor activities;
• Agree to comply with all property rules and safety directions
